A major controversy has erupted in Mumbai’s upscale Bandra West Carter road area after a resident lodged a serious FIR alleging death threats, rape threats, illegal construction, land grabbing, and alleged corruption involving Bmc officials

The incident revolves around an ongoing illegal hotel and eating house construction at CTS No. 1472, Yummies Hotel Near Rizvi College, 36 Sherly Rajan Road, Bandra West, a property land reportedly owned by the Petit Trust.

According to Seagull Building resident Mr. Zamir Sayed i have lodged an FIR at Khar Police Station on January 5, 2026, against: Hotelier Saurabh Shikre ,Alleged occupiers and proclaimed owner Alton and Melton Fernandes
The FIR (No. 0164/2026) has been registered under provisions of the Bharatiya Nyaya Sanhita (BNSS) relating to criminal intimidation and threats.

“Mr. Zamir alleged that when residents objected to the illegal construction activity, the accused persons issued death and rape threats, threatened him, and used abusive language targeting his religion

Illegal Hotel Construction on Trust Property
Sources reveal that the disputed property belongs to the Petit Trust, while the Fernandes family allegedly occupied the land for several years with temporary structures.

In DCR the same CTS is showing agriculture land apprx 450 sq mtr.

Residents claim that:
The Fernandes family recently rented out the entire land, measuring nearly 5,000 square feet, to hotelier Saurabh Shikre.
A large-scale hotel and eating house structure has been under construction for the last four months.

Residents and trust representatives allege that the construction is being carried out without mandatory permissions, including:
No Building Proposal approval from EEBP,
No IOD or Commencement Certificate
No NOC from Petit Trust
No Development Control Regulation compliance.

BMC Issued Multiple Notices Declaring Structure Illegal Official records accessed by complainants reveal that the Brihanmumbai Municipal Corporation (BMC) H West Ward Khar had already declared the construction illegal.

Key documents include:
Notice under Section 354(A) of MMC Act dated 01 October 2025.

Speaking Order issued on 03 October 2025. Notice dated January month.

Despite these notices, residents alleged that construction activity continued with only minor demolition carried out two months ago.

Multiple complaints ignored
Complaints regarding the illegal structure were filed by:

Petit Trust (09 December 2025)

Seagull Building residents (29 November 2025)

Advanced Locality Management (ALM) group also submitted written Complaint regarding this illegal Constructions at U West ward in November month.

Residents claim that no substantial enforcement action has been taken so far.
Serious Corruption Allegations Against BMC Officials.

The complainant has alleged that certain civic officials from H West Ward are protecting this illegal construction.

The allegations include:
Manipulation of official records
Allegedly Issuance of a “No Action Pending” certificate to MOH without site verification Processing eating house license despite lack of legal approvals.

The allegations specifically name:
Bmc H West Ward  Junior Engineer Kishor Pawar,Assistant Municipal Commissioner, Fire Officer and Medical Health officer of H WEST Ward.

OFFICIALS from BMC have not yet issued an official response to these allegations.

Eating House License Under Controversy
Residents have alleged that the Medical Health Officer H West Ward is allegedly processing license approval without:
Verifying approved building plans
Conducting physical site measurement
Obtaining trust ownership NOC
Legal experts state that granting license under such circumstances could amount to serious regulatory violations.

Residents Demand Immediate Action
Local residents, trust representatives, and ALM members have demanded:
Immediate demolition of the illegal structure Independent investigation into civic officials Protection for complainants
Action against accused persons

Police and Civic Authorities Under Public Watch
The case has raised serious concerns about:
Illegal commercialization of trust property
Safety of citizens raising civic complaints
Alleged nexus between builders and officials
Authorities are expected to face increasing pressure as the matter gains public attention.

Disputed Construction Site Picture

Senior Police Inspector Sanjiv Dhumal of Khar Police Station, while speaking to Hello Mumbai News over the phone, confirmed the incident related to the demolition of a controversial hotel structure by the Brihanmumbai Municipal Corporation (BMC).
According to Inspector Dhumal, when officials from the BMC H-West Ward approached the site to carry out the demolition drive, the complainant began recording a video of the demolition process. This act was objected to by the other party present at the site, following which a physical altercation broke out between both parties.
Police have registered cross FIRs against both sides in connection with the incident. Inspector Dhumal stated that further investigation is currently underway to ascertain the complete sequence of events and fix responsibility.

Civic authorities are yet to issue a formal clarification regarding the corruption allegations.Hello Mumbai Called to H west Officers for their quote on this issue but nobody responded
