Major relief for Muslim Community, Ban on Slaughter PIL rejected!!
Mumbai: Muslims in Mumbai can heave a sigh of relief and celebrate Eid al-Adha (Bakri Idd) with enthusiasm as the Bombay High Court has allowed the slaughtering of animals outside Deonar abattoirs and rejected the PIL on the ban of slaughter!
Overruling the stay that an NGO Jiv Maitri Trust had sought seeking ban of the slaughter of animals outside Deonar abattoirs Chief Justice Naresh Patil said, “The rule of law is applicable for each religious festival. We understand that it is not easy for the state administration to regulate religious activities in accordance with the legal framework. That is why you (state) must have uniform policies to deal not just with permission for animal slaughter, but also with permissions for other religious activities.”
It may be noted that Adv Mohammed Zain Khan and his team comprising of Adv Zaid Ansari, Adv Mohammed Ahmed, Adv Akram Kapoor had intervened in the matter on behalf of Bhartiya Sevak Sangh and informed the Hon’ble Court that Commissioner has power under MMC Act 1888 to issue permission and cancellation of permissions on last moment will cause problems to Muslim community at large. The court understood the defence argument and rejected the PIL of Jiv Mitra. Nevertheless the High Court directed the Petitioner, Municipal Corporation, and Adv Mohammed Zain Khan to find a better solution for issuing permissions and carrying out the slaughter in a legal and systemic method from next year!
Elated at the landmark judgment and the bravo confrontation by Advocate Zain Khan, Haji Arfat Senior Shiv Sena leader and President of Khatik Samaj (Maharashtra) felicitated Advocate Zain Khan for his commendable feat by offering him a shawl and bouquet at his office.
Speaking with Hello Mumbai News he said, “I appreciate the efforts of this young Adv Zain Khan who fought well and got the order in favour of our community. He nullified all the attempts of communal forces who tried to disturb the communal harmony of the city by creating an obstacle in the celebration of Bakri Idd festival through his stupid PIL and hurting the sentiments of the Muslim Community. On behalf of all Muslim community, I am thankful to this advocate.”
