A private complaint was filed by Advocate Ali Kaashif khan against Dr.Deepak Namjoshi, Owner of Criticare Hospital, his wife Masooma Namjoshi, Shashikant Patkar, Sandip Raju Naik and 8 others u/s 406, 420, 419, 465, 467,468,471 of IPC in Andheri Magistrate court for alleged acts of cheating, criminal breach of trust and forgery for not delivering property to the complainants, victims since more than 35 years despite the agreement and malafidely giving the said property to another people by cheating.
According to Advocate Ali khan Kashif, a private complaint was filed on 19/12/2018 by one of the four complainants- victim Mrs. Shamim Zaibulla Khan against Dr. Deepak NamJoshi and Masooma NamJoshi (Criticare Hospital Owners) and 10 others u/s 406, 419, 420, 465, 467, 468, 471 for the criminal acts of criminal breach of trust, cheating, forgery of the Indian Penal Code and today the Honourable Magistrate Court at Andheri, Mumbai has issued process against all the accused.
The said order was passed when on the previous date of argument, the Andheri Police Station had filed report in two other cases filed by Mrs. khatoon Khan and Ruksana Khan against all the accused affirming that a civil case is already pending in the City Civil Court, Dindoshi in which the Court then asked to file protest petition against police report. Whereas since the present case was kept back for arguments, the Court got convinced and directly issued process in the Shamim Khan matter as it was not yet sent for police report.
Speaking to Hello Mumbai News, Dr. Deepak Namjoshi of Criticare Hospital, said, ” I am being tortured and out to mental trauma. My name has been allegedly figured and am being targeted. I will follow and let the law takes it’s course. I am not a developer. I have purchased the plot from Om Grinetri developers and Chintan developers and constructed the nursing home.
I wasn’t involved with any tenant rehousing. All re- housing was done before buying the plot.
The rehousing building with occupation certificate was standing on the plot before I purchased it. My plans have been approved for hospital. I have not submitted any plans for rehousing. I have no direct or indirect agreement with any tenant. I have also been cheated by the developers who have sold me the plot.
Dr Deepak Namjoshi, further affirmed that whatever rehousing process was started by Gauriben in 1983 at that time that I was a 7th standard student.
With no figment of imagination, how can I be involved in a 1983 transaction? I am being dragged into this because my hospital is there and because I was present in the premises. An effort is being attempted to get some money out of me. I am approaching the courts to explain my position and get appropriate relief.
