Conviction of Afghan National Residing in India with False Identity

A 38 year old An Afghan national named Habibullah Prang (alias Zaheer Ali Khan) Convicted for allegedly staying illegally in Mumbai for the past 17 years.as per the evidence provided by Mumbai Crime Branch before the Court,the Hon’ble Additional Chief Metropolitan Magistrate, 8th Court, Mumbai, convicted the accused. The court sentenced him to 11 months of imprisonment and imposed a fine of ₹8,000/-. The court also ordered his deportation to Afghanistan.

As per the press note  Afghanistan national was arrested for allegedly staying illegally in India for the past 17 years, a Mumbai Crime Branch official said on Thursday.

He was using a fictitious name and was involved in making fraudulent documents, the official said.

Brief History of the Case 

The Crime Branch, Mumbai, Unit-5, registered Crime No. 19/24 under Sections 465, 468, and 471 of the IPC, along with Sections 12(1)(a) and 12(3) of the Passport Act, Rule 6 of the Foreigners Order, 1948, and Sections 5 and 14(a)(b) of the Foreigners Act. An Afghan national named Habibullah Prang (alias Zaheer Ali Khan), aged 38 years, originally from Tamer Zurmat District, Pakita Province, Afghanistan, was found residing in India under a false identity.

Acting on confidential information, the Unit-5 team conducted a raid and discovered that the accused had been living in Wadala, Mumbai, since 2007 using forged documents, including a PAN card and a driving license issued under the name  Zaheer Ali Khan.

Unit Incharge Police Inspector Ghanshyam Nayar, Investigating Officer Sadanand Yerekar, Court Officer PSI Vijay Bendale, and Police Constable Rausaheb Funde played an important role in securing the conviction.
