Are the ‘Netas’ Above the Law? Despite HC Order, Shiv Sena leader’s Ganesh Pandal at Bandra stands tall without BMC Action!!!
The State Government Finds 132 illegal pandals in Mumbai and 54 illegal pandals in Thane!!! But BMC took No Action!!!
The Court of Law is considered most ‘Most Revered’ and any violation of the Court order is regarded as Contempt of Court and is a serious crime but strangely each year the local Netas in Mumbai, who organize festivals like Dahi Handi and Ganesh Mandals mock the Court Orders and are left free!
Readers may be aware that the High Court had ordered to dismantle a portion of the massive Ganesh Pandal on SV road in Bandra which encroached upon the footpath and even covered an entire Bus Stop! The Pandal had dug as many as 16 holes on the road to erect the huge pandal hence angry over the violations of High Court orders, BMC was ordered to immediately raze the illegal portion of the pandal.
But alas! BMC gave a Nelson Eye to High Court order!!! The pandal still stands tall without any action against it!!! The reason it belongs to powerful Shiv Sena leader Sudesh Dubey in Bandra West!!!
It may be noted an NGO Awaaz Foundation had filed a PIL against illegal Ganesh Pandals in Mumbai and the suburbs. A division bench of Justice A S Oka and Justice M S Sonak had asked BMC to reply and in its survey, the state government found 132 illegal pandals in Mumbai and 54 illegal pandals in Thane. Lawyers Rohaan Cama and Shanay Shah, appearing for Awaaz Foundation lamented that BMC has not taken any action against these illegal pandals.
Similarly a few weeks ago the High Court had restricted the height of human pyramids to 20 feet and also banned the participation of minors in the risky sport. Also, the HC had ordered to control sound pollution but tragically none of the three HC rules were obeyed by the Dahi Handi Mandals in Mumbai.
HELLO MUMBAI questions –Why are the culprits not punished for violation of the orders of the honorable High court? Shouldn’t the Supreme Court take suo moto action on this defiance of the orders of a High Court’??
It’s a SHAME that rule of law, one of the essential associate of a democratic society, is not given its due respect by Indian society. –Edited and Written: Mansoor Khan
