
Mumbai: MCA Secretary Sanjay Naik approached Mumbai High Court for squashing of FIR, Court rejected his request.
Mumbai: Mumbai Cricket Association Secretary Sanjay Naik made headlines for his illegal restrictions and opposing the burial of a Covid-19 infected Muslim deadbody in the MCGM Notified Navapada Kokni Kabristan Bandra(w) at the behest of Ijaz Shaikh, Trustee of Kokni Kabristan Bandra West bandra police registered an FIR against Naik , he moved to Bombay High court for quashing of FIR but Court refused to give any kind of relief to him .
Earlier on 6th May, 2020, FIR was filed against Sanjay Naik and others under IPC Section , 341, 269,270,188, 506 and 34. Regrettably, no arrests have been made as yet .
Meanwhile, Sanjay Naik knocked the doors of Hon’ble Bombay High Court for quashing of FIR and on 19/05/2020 the Petition was heard through Video Conference before Justice S K Shinde.
Sanjay Naik’s Advocate Kevin Gala and Samaa Shah argued that the FIR was mala-fide and asked the Court to direct the Investigating Agency not to take any coercive action and not to file charge sheet against him otherwise he will lose his Office of Secretary at Mumbai Cricket Association.
Thr Original Complainant Ijaz Shaikh, Trustee of Kokni Kabristan represented by their Advocates Mr.Mohsin Shaikh & Mr.Kamran Shaikh argued that the FIR was not Malafide and that the Petitioner had the remedy to obtain Bail as all the Sections were bailable and further requested the Court to allow the Investigating Agency to proceed with the Investigation. The Public Prosecutor informed the High Court that it would take more than 4 weeks to file the Charge Sheet.
Further it was Ordered that Charge Sheet not to be filed before the next date i.e. 16/06/2020 but it was further clarified that the Investigating Agency shall proceed with the Investigation.
The complainant disclosed that Shri Sanjay Naik, on two earlier occasions had repeated the same act in respect of burial of Covid19 infected dead body & had caused obstacles to Police & MCGM Officials which is hurting the sentiments of Muslim community.
